1. About Prime Care

Prime Care is an OPD (outpatient) health benefit programme operated by Zap Private Limited("Zap", "we", "us"). The programme is powered by Alyve Health Pvt. Ltd. and underwritten by IRDAI-licensed general insurers including HDFC ERGO and GoDigit General Insurance. By purchasing a Prime Care plan you agree to these Terms & Conditions.

2. Eligibility

Prime Care plans are available to Indian residents aged 18 years and above. By subscribing you confirm that all information provided - including name, mobile number, email address, and identity details - is accurate and belongs to you or the family member being covered.

3. Plan Benefits & Wallet

• Each plan carries an annual OPD wallet (₹10,000 / ₹15,000 / ₹20,000 depending on plan tier) which may be used at Alyve Health's network partners.
• Wallet limits are sub-categorised by benefit type (consultations, diagnostics, pharmacy, vision, dental). Unused wallet balances do not carry forward to the next policy year.
• The Alyve QR transaction limit is ₹1,000 per transaction. Multiple transactions may be used within benefit sub-limits.
• Benefits are activated upon confirmation of successful payment and completion of KYC verification.
• Family and Extended Family plan wallets are shared across all covered members.

4. Annual Health Check-up (AHC)

One Annual Health Check-up is included in all plans. ₹1,500 is deducted from the diagnostics sub-wallet per AHC utilised. The AHC must be booked through the Alyve Health app or concierge desk.

5. Billing & Payments

• All plans are billed annually. Annual pricing includes 11 months billed with one month free.
• Payments are processed through Razorpay and are subject to Razorpay's terms of service.
• Zap Private Limited does not store any card, UPI, or banking credentials.
• All prices are inclusive of applicable taxes unless stated otherwise.

6. Free Look Period & Cancellations

You may cancel your plan within 15 days of purchase for a full refund, provided no benefits have been utilised. After the free-look period, annual plans may be cancelled with a pro-rata refund for unused months, minus any benefits already consumed. Refunds are processed within 7-10 working days to the original payment method.

7. Activation Timeline

Plan activation may take up to 2 working days from the date of confirmed payment. During this period benefits are not yet active. Zap Private Limited is not liable for any healthcare expenses incurred prior to activation confirmation.

8. Exclusions

• Hospitalisation, surgery, or in-patient procedures are not covered under Prime Care.
• Pre-existing conditions are not excluded from OPD consultations, but diagnostic tests related to pre-existing conditions may be subject to sub-limit caps.
• Cosmetic procedures, fertility treatments, and experimental therapies are excluded.
• Benefits cannot be redeemed for cash or transferred to another person.

9. Network Partners

Benefits are redeemable only at Alyve Health's empanelled network partners. Zap Private Limited does not guarantee the availability, quality, or continuity of any specific partner's services. The network may change from time to time; current partner lists are available on the Alyve Health platform.

10. Limitation of Liability

Zap Private Limited's aggregate liability to any subscriber shall not exceed the annual premium paid for the relevant plan year. We are not liable for indirect, consequential, or incidental damages arising from your use of Prime Care benefits.

11. Modifications

Zap Private Limited reserves the right to modify these Terms & Conditions, plan pricing, or benefit structures with 30 days' notice. Continued use of your plan after such notice constitutes acceptance of the revised terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Bengaluru, Karnataka.

This Privacy Policy applies to Zap Private Limited("Zap", "we", "us", "our"), the operator of Prime Care. We are committed to protecting your personal information and handling it responsibly in accordance with the Digital Personal Data Protection Act, 2023 (DPDPA) and applicable IRDAI guidelines.

2. Data We Collect

• Identity data: Full name, date of birth, PAN number (for KYC)
• Contact data: Mobile number, email address, residential address
• Health data:Plan selections, benefit utilisation records, annual health check-up results (shared by Alyve Health's diagnostic partners)
• Financial data: Transaction IDs and payment confirmation records. We do not store card numbers, UPI IDs, or bank account details.
• Technical data: IP address, browser type, pages visited, and device information collected via standard web analytics.

3. How We Use Your Data

• To activate and manage your Prime Care plan
• To verify your identity (KYC) as required by IRDAI regulations
• To process payments and issue refunds
• To communicate plan updates, benefit reminders, and renewal notices
• To enable Alyve Health and its network partners to honour your benefit claims
• To comply with statutory, regulatory, and legal obligations
• To improve our products and services (in aggregated, anonymised form only)

4. Legal Basis for Processing

We process your data on the following bases: (a) contract - to perform our obligations under your Prime Care plan; (b) legal obligation - to comply with IRDAI, DPDPA, and tax regulations; (c) consent - for marketing communications, which you may withdraw at any time.

5. Data Sharing

We do not sell your personal data. We share data only with:

• Alyve Health Pvt. Ltd. - to activate and manage your benefits and Alyve QR
• HDFC ERGO / GoDigit - as underwriting partners for regulatory compliance
• Razorpay - solely for payment processing
• Network partners (clinics, labs, pharmacies) - limited to transaction details required to honour your benefit claim
• Regulatory authorities - IRDAI, IT Department, or other statutory bodies when legally required

All third-party partners are bound by confidentiality obligations and are prohibited from using your data for their own marketing purposes.

6. Data Retention

We retain your personal data for the duration of your plan and for 7 yearsthereafter, as required by Indian financial and insurance regulations. Health data is retained for 3 years after plan expiry unless a longer period is mandated by law.

7. Your Rights (DPDPA 2023)

Under the Digital Personal Data Protection Act, 2023, you have the right to:

• Access - request a copy of the personal data we hold about you
• Correction - request correction of inaccurate or incomplete data
• Erasure - request deletion of your data (subject to regulatory retention obligations)
• Grievance redressal - raise a complaint with our Data Protection Officer
• Nominate - nominate an individual to exercise rights on your behalf in the event of death or incapacity

8. Data Security

We implement industry-standard security measures including TLS 1.2+ encryption for data in transit, AES-256 encryption for sensitive data at rest, access controls limited to authorised personnel, and regular security audits. In the event of a data breach that is likely to affect your rights, we will notify you within 72 hours as required by law.

9. Cookies & Analytics

Our website uses essential cookies for functionality and analytical cookies (Google Analytics) to understand usage patterns. You may disable non-essential cookies via your browser settings. Disabling cookies will not affect your ability to purchase or use a Prime Care plan.

10. Children's Privacy

Prime Care plans may cover children as dependants under a Family plan, but the plan holder must be an adult (18+). We do not knowingly collect personal data directly from individuals under 18 years of age.

11. Changes to This Policy

We may update this Privacy Policy from time to time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before they take effect.
